TERMS AND CONDITIONS OF USE
Welcome to the ReLOVution Platform!
The Platform provides personalized subscription services that allow Users to access entertainment
content via the internet, computer, and other compatible devices.
This document explains how Users can use the Platform and its Content. Please read it carefully
and keep a copy!
Using the Platform implies the complete knowledge and express acceptance of the conditions
described herein by the User. If, after reading them, the User does not intend to accept them, they
are invited not to continue browsing or to register.
If clarification is needed, please contact Identity, which will be fully available to the User!
ART. 1 - DEFINITIONS
The expressions listed below, both in the singular and plural, have the meaning specified next to
each of them:
Identity: with its registered office in Turin (TO) Corso Francia No. 54, VAT and Tax Code
No. 12950850011, certified email: info.identitysrl@pec.it, email: support@id-entity.it, which
manages the Platform, the first, second, and third-level domains, and owns the same, the
Content, and the services provided through them; the manager and/or owner of the
supporting IT and non-IT infrastructure;
Platform: the website www.therelovution.com and all domains referenced by the site
managed by Identity, which provides an information society service consisting, among other
things, of offering Users the opportunity to purchase products and services and to enjoy
Content;
User: the natural person of legal age who has registered their data on the Platform and has
a Profile at their disposal under a license;
Profile: the reserved area uniquely attributable to a User, consisting of a digital
environment with customizable content and functionalities, isolated from other Profiles, and
licensed together with a unique password and username chosen by the User and assigned
to them;
Content: all materials present on the Platform, without exception, owned by Identity or its
licensors (including but not limited to texts, images, photographs, documents, video
materials, logos, designs, models, original or reproduced works, including software, site
operating logics, menus, layouts, graphics, and colors, etc.), even if not qualifying as
creative works of the mind;
Payment Method: a current, valid, and accepted payment method, which may be updated
periodically and includes payments made for the User through a third party;
Terms and Conditions: these Terms and Conditions of Use of the Platform.
ART. 2 - USE OF THE PLATFORM
The User can use the Platform freely and under their total and exclusive responsibility.
To use the Platform, the User must register by creating a Profile on the Platform.
To register, the User:
must be at least 18 years old and confirm this upon first accessing the Platform; must provide a valid email address and a unique password or alternatively use their
Google, Facebook, or iCloud account.
The User may not use the Platform:
if they do not have the legal capacity to act and to enter into binding agreements according
to the applicable laws;
if Identity has disabled the Profile for violating the Terms and Conditions or due to disputes
with the same.
Anyone not meeting the above requirements should not register on the Platform.
Identity reserves the right to take legal action against any direct or indirect violation of these Terms
and Conditions. To this end, a unique alphanumeric code may be associated with each Content,
allowing individual tracking of each use of the Content and tracing back to the User in case of
violation of these Terms and Conditions.
Identity informs the User that the Platform Content may contain errors or inaccuracies.
ART. 3 - USER OBLIGATIONS AND RESPONSIBILITIES
By using the Platform, the User agrees to:
comply with these Terms and Conditions;
not use the Platform and its subdomains for illegal, deceptive, defamatory, discriminatory
purposes, or for unlawful activities;
not provide false personal information and/or that of third parties;
not attempt to tamper with any part of the Platform, damage it, or compromise its operation;
not probe, examine, or test any vulnerabilities of the Platform or any network connected to
it, nor violate its security or authentication measures;
not attempt to upload data, information, or programs containing viruses or other harmful or
damaging code in violation of the law, including those protecting the intellectual property of
Identity or third-party rights;
not use the Platform for unlawful purposes or purposes different from those provided in
these Terms and Conditions;
not exploit the Platform for commercial or professional purposes;
not modify, adapt, translate, or decompile any part of the Platform;
not use robots, spiders, site search/retrieval applications, or other devices to retrieve or
index any part of the Platform or the content published on the Platform or to collect
information about Users for unauthorized purposes;
not duplicate, reproduce, publish, or disseminate by any means and in any form the
Content present on the Platform;
use the chat correctly, avoiding any illegal, deceptive, defamatory, or discriminatory
behavior.
Unless expressly authorized by Identity, the User agrees not to: store, reproduce, distribute, modify, display, disclose, publish, license, create derivative
works, offer for sale, or use the Content;
circumvent, remove, alter, disable, spoil, block, obscure, or interrupt the protections of the
Content or other elements of the Platform;
use any data mining or data collection and extraction methods.
Furthermore, to always ensure the security of the User's data and Profile, by using the Platform,
the User agrees to:
store and keep the Profile password in a safe place and under the direct control of the
User;
not assign, transfer, share, and/or communicate the Profile password to third parties;
not assign or transfer the Profile to third parties;
keep their account and password confidential and monitor access to their computer and
mobile devices;
take all necessary precautions to ensure that the password remains secure and
confidential.
In any case, if the User detects any abnormal activity concerning the Profile, they must
immediately inform Identity by sending an email to support@id-entity.it.
The Profile password is for personal use only and must be kept confidential. If a third party
accesses the Profile, the User agrees that this third party will be considered to be acting on behalf
of the User and to be bound by any changes made to the Profile, including, but not limited to,
changes to the subscription plan. To maintain control of the Profile and prevent unauthorized users
from accessing it, the User must monitor the devices used to access the service and not
communicate the password or Payment Method details associated with the Profile to third parties.
The User agrees to provide and update if necessary the information of their Profile, including a
valid email address that allows Identity to send communications to the User regarding the Profile.
Identity reserves the right to close or suspend the Profile to protect the User, Identity, its partners,
and/or the Platform from identity theft or other fraudulent activities.
ART. 4 - PLATFORM AVAILABILITY
Identity has the right at any time to:
make the Platform accessible and make the Content available, in whole or in part, in the
times and ways determined at its sole discretion;
delete, remove, or modify the Content;
modify the Platform and, in general, everything contained and/or made available, including
the graphical interfaces and functionalities at its sole discretion and without any obligation
towards the Users;
suspend the availability of the Platform, in whole or in part, and for the necessary time,
even in the case of ordinary or extraordinary maintenance.
The User expressly agrees that Identity provides no warranty regarding the continuity or proper
functioning of the Platform. Therefore, Identity cannot be held liable in any case for the total or
partial unavailability of the Platform and/or the Content, where such unavailability is due, by way ofexample but not limited to, to a fact attributable to the network access service providers or where
the Platform requires maintenance and/or updates that cannot be performed without interruption
and/or suspension of its availability.
ART. 5 - INTELLECTUAL PROPERTY
All Content on the Platform is the result of an investment of economic and intellectual resources
that has allowed Identity to develop innovative Content and stand out from the competition.
Identity therefore informs the User that any activity (such as, but not limited to, duplication, total
and/or partial reproduction, publication, or dissemination by any means and in all forms)
concerning the Content present on the Platform and/or part of the Content, except for personal use
within the limits of these Terms and Conditions, is prohibited.
The Platform and all Content therein are the exclusive property of Identity and are also protected
by copyright and industrial property laws.
So-called deep links or framing techniques designed to prevent recognition of (or to mask) the true
authorship of the Content are also prohibited.
It is expressly forbidden to use any part of the Platform and its Content for directly or indirectly
professional, commercial, and/or advertising activities of any kind.
ART. 6 - DOMAIN NAMES, NAMES, TRADEMARKS, AND DISTINCTIVE SIGNS
“ReLOVution” and the logos and trademarks used on the Platform are names and/or distinctive
signs of which Identity is the owner and/or exclusive licensee and on which it has exclusive
economic exploitation rights. The use and reproduction of such names and/or distinctive signs and
logos present on the Platform in any form and manner are prohibited unless expressly authorized
in writing by Identity.
ART. 7 - PROFILE LICENSE
The User will have the right to use their Profile under a temporary and non-transferable license. No
further use is allowed other than those expressly provided for in these Terms and Conditions.
Identity may, without prior notice and authorization, at its sole discretion, suspend, inhibit access,
and/or impose restrictions on the User's Profile if deemed appropriate to protect the interests of the
User or its interests and, among others, in the following cases: repeated and/or serious violations
of these Terms and Conditions, for security reasons, to comply with legal obligations, or in case of
suspected illegal activities and for breach of confidentiality of correspondence.
The User has the possibility to request the deletion of their Profile at any time.
Identity has the right to temporarily or permanently suspend the Platform, and therefore, in such a
case, the User will not have access to the Platform or their Profile.
ART. 8 - SUBSCRIPTIONS
To subscribe to the service, you must be at least 18 years old. Minors cannot use the service in
any way, even under adult supervision. The Platform and any Content accessible through the
Platform are intended for personal and non-commercial use only and cannot be shared with third
parties. For the duration of the subscription, Identity grants a limited, non-exclusive, and non-
transferable right to access the Platform and the Content. Except as provided above, no other
rights, title, or interest will be transferred to the User, who agrees not to use the service to share it
with third parties, including public screenings.
To use the services offered by the Platform, the User must have Internet access and a device
compatible with the Platform.
Each subscription to the Platform will have the duration indicated at the time of subscription and
will continue until it expires and is automatically renewed.
Unless the User cancels the subscription before the billing date, Identity is authorized to charge thesubscription fee for the next billing cycle to the User's chosen Payment Method. You can cancel
the subscription renewal through the Profile or by contacting Identity at the email address
support@id-entity.it. In any case, the user can cancel the automatic renewal by contacting CCBill's
Consumer Support department at https://support.ccbill.com/. The User can find specific information
about their subscription within their Profile.
At its discretion, Identity may offer subscription plans or special promotional offers ("Offers"). The
User can check the available Offers on the Platform or, in the case of dedicated Offers, within their
Profile before proceeding with payment.
Regarding subscription plans, the User can change their plan at any time, even after full payment,
by switching to a more expensive subscription plan and paying the related price difference. If the
switch to a more expensive subscription plan occurs before the expiration of the previously active
plan, the User will still have immediate access to the services of the more expensive subscription
plan, even for the remaining time of the previous plan. The duration of the more expensive
subscription plan will begin to run upon the expiration of the previous plan.
Identity determines at its sole discretion the User's eligibility for Offers and reserves the right to
revoke an Offer and suspend the Profile if it is determined that the User is no longer eligible for the
Offer. To determine eligibility for the Offer, Identity may use information such as the device ID,
Payment Method, or an email address used with a subscription. Eligibility requirements and other
limitations and conditions will be disclosed to the User at the subscription of the Offer or by other
communication methods made available to you.
The available Content may vary periodically and depending on the geographical area from which
the User connects.
The Content library is regularly updated.
Identity has the right to limit or discontinue the User's use of the service if the latter violates these
Terms and Conditions or uses the Platform and/or the Content in an illegal or fraudulent manner.
The quality of the Content display may vary depending on the User's device and may be affected
by a range of factors such as your geographical location, available bandwidth, or Internet
connection speed. The availability of HD, Ultra HD, and HDR formats depends on the Internet
service the User uses and the characteristics of the device used. Not all Content is available in all
formats, such as HD, Ultra HD, and HDR, and not all subscription plans allow receiving Content in
all formats. The minimum connection speed required for HD video quality (resolution 720p or
higher) is 30 Mbps per stream; however, a faster connection is recommended for better video
quality. A connection speed of at least 50 Mbps per stream is recommended to receive Full HD
video quality (resolution 1080p or higher). A connection speed of at least 150 Mbps per stream is
recommended to receive Ultra HD video quality (resolution 4K or higher). All Internet access costs
will be borne by the User, who can check any data consumption charges with their Internet
provider. The time needed to start watching Content may vary based on a range of factors,
including the User's geographical location, the available bandwidth at that time, the selected
Content, and the device configuration.
ART. 9 - EXCLUSION OF THE RIGHT OF WITHDRAWAL
The User acknowledges and agrees that the right of withdrawal recognized to consumers by the
Consumer Code is excluded with reference to each Content purchased on the Platform individually
or by virtue of a subscription plan, in accordance with the provisions of Article 59, paragraph 1,
letter o) of the Consumer Code (provision of digital content through a non-material medium if
execution has begun with the consumer's agreement and acknowledgment that they would lose
the right of withdrawal).
ART. 10 - BILLING AND CANCELLATIONThe subscription fee will be charged to the User's chosen Payment Method on the payment date
indicated within the Profile. The duration of the billing cycle will depend on the type of subscription
plan chosen when registering for the service. In some cases, the payment date may vary, for
example, if the charge to the Payment Method indicated by the User fails, if the User changes their
subscription plan, or if the paid subscription started on a day not present in a certain month. To
view the date of the next payment, the User can visit the "Billing Information" section within the
Profile.
To use the service, the User must provide one or more Payment Methods and authorize Identity to
charge any Payment Method associated with their account if the primary Payment Method is
declined or cannot be used to settle the subscription fee. The User is solely responsible for any
unpaid amounts. If a charge fails due to the expiration of the Payment Method, insufficient funds,
or for any other reason, and if the User has not canceled the Profile, Identity may suspend access
to the service until a valid Payment Method has been successfully charged. For some Payment
Methods, the issuer may charge the User certain fees, such as for international transactions or
other charges associated with processing the Payment Method. Local taxes charged may vary
depending on the Payment Method used. For more details, please check with the service provider
linked to the chosen Payment Method.
The User can update their Payment Methods within their Profile. Identity may update the Payment
Methods based on data received from payment service providers. Following each update, the User
authorizes Identity to continue charging the available Payment Method(s).
The User can cancel the subscription at any time, continuing to have access to the service until the
end of the billing period. Refund requests will be considered if the User has partially used the
subscription or has not used the Content present on the Platform. The User can cancel the
subscription within the Profile by following the cancellation instructions. The User can cancel the
automatic renewal of their subscription by contacting CCBill's Consumer Support department at
https://support.ccbill.com/.
Following the cancellation, the Profile will automatically be closed at the end of the current billing
period. You can check the Profile's closing date by clicking on "Billing Information" within the
Profile.
From time to time, Identity may, at its discretion, modify the subscription plans and the service
price. Among the cost elements that affect the service price are, for example, production and
licensing costs, technical supply, and service distribution costs, customer service and other sales-
related costs, general administration costs, and other general costs, as well as taxes, fees, and
contributions provided for at the state level. Identity will notify the User at least one month before
the date the price or subscription plan changes take effect. If the User does not wish to accept the
price or subscription plan change, they may cancel the subscription before the change takes effect.
ART. 11 - CORRESPONDENCE WITH IDENTITY
Correspondence with Identity and within the Platform is intended to be confidential and exclusively
for the User. It may not, therefore, be disseminated in any form. In the event of unauthorized
disclosure and/or communication, Identity may take all appropriate actions to protect its interests,
including the suspension or cancellation of the Profile for violation of these Terms and Conditions
and legal action for crimes under Articles 616 (violation, removal, and suppression of
correspondence) and 618 (disclosure of the content of correspondence) of the Penal Code.
ART. 12 - CUSTOMER ASSISTANCE
For more information regarding the Platform and its features or if the User needs assistance with
their Profile, they can send an email to support@id-entity.it.
ART. 13 - LINKS TO OTHER WEBSITESThe Platform may contain links to third-party websites.
Identity disclaims any responsibility for actions and/or omissions resulting from the use of
information and content from such third-party websites and does not guarantee the completeness
and accuracy of the content and information provided by them.
ART. 14 - PROCESSING OF PERSONAL DATA
The processing of personal data will be carried out by Identity in full compliance with the current
European and Italian regulations on personal data protection (EU Regulation No. 679/2016, known
as the “GDPR” - and Italian Legislative Decree 196/2003, known as the “Privacy Code,” in the
parts not expressly repealed by Legislative Decree No. 101/2018), as indicated in the Privacy
Policy and Cookie Policy, which we invite you to read carefully.
ART. 15 - APPLICABLE LAW AND JURISDICTION
Any disputes arising in connection with these Terms and Conditions shall be subject to Italian
jurisdiction, and the applicable substantive and procedural law shall be Italian law, without
reference to any conflicts of law principles.
The User agrees and submits to the exclusive jurisdiction of the Italian Courts and expressly
waives any objection regarding such jurisdiction. The exclusive competent court, unless otherwise
provided by mandatory law, is the Court of Turin, and any other court is excluded.
Pursuant to Art. 19 of Italian Legislative Decree 70/2003, Identity and/or the User may resort to
out-of-court dispute resolution bodies that also operate electronically. It is also possible to contact
the European Union's ODR platform, available at the following link:
